Assalamu ‘alaikum wr. wb.
Redaksi Bahtsul Masail NU Online, dalam sebuah hadits Rasulullah SAW mengizinkan suatu kaum untuk meminum air kencing unta. Sementara ulama berbeda pendapat perihal meminum air kencing unta ini. Sebagian ulama menyatakan haram, sebagian ulama menyatakan tidak haram. Bagaimana kita menyikapi perbedaan tersebut? Mohon penjelasannya. Terima kasih. Wassalamu ‘alaikum wr. wb. Jawaban
Assalamu ‘alaikum wr. wb.
Penanya yang budiman, semoga Allah SWT menurunkan rahmat-Nya untuk kita semua. Sebelum masuk jauh ke inti persoalan, perlu disinggung di awal bahwa para ulama membagi dua kategori najis. Pertama, benda yang disepakati ulama status najisnya, yaitu daging babi, darah, air kencing manusia, muntah dan kotoran manusia, khamar, nanah, madzi, dan lain sebagainya.

Kedua, benda yang diperdebatkan ulama perihal status najisnya, yaitu anjing, kulit bangkai, air kencing anak kecil yang belum makan apapun selain ASI, mani, cairan pada nanah, dan lain sebagainya. Air kencing unta termasuk kategori kedua ini. Hal ini disebutkan secara rinci oleh Syekh Wahbah Az-Zuhayli sebagai berikut:

ثانياً ـ النجاسات المختلف فيها: اختلف الفقهاء في حكم نجاسة بعض الأشياء… بول الحيوان المأكول اللحم وفضلاته ورجيعه: هناك اتجاهان فقهيان: أحدهما القول بالطهارة، والآخر القول بالنجاسة، الأول للمالكية والحنابلة، والثاني للحنفية والشافعية.

Artinya, “Jenis kedua adalah najis yang masih menjadi perbedaan pendapat di kalangan ulama. Ahli fikih berbeda pendapat perihal status najis sejumlah benda ini... Salah satunya adalah air kencing, kotoran, dan zat sisa tubuh hewan yang boleh dimakan. Di sini pandangan ulama fikih terbelah menjadi dua. Satu pandangan menyatakan suci. Sementara pandangan lainya menyatakan najis. Pandangan pertama dianut oleh madzhab Maliki dan Hanbali. Sedangkan pandangan kedua diwakili oleh madzhab Hanafi dan madzhab Syafi‘i,” (Lihat Syekh Wahbah Az-Zuhayli, Al-Fiqhul Islami wa Adillatuh, Beirut, Darul Fikr, cetakan kedua, 1985 M/1405, juz I, halaman 160).
